Firebombing Suspect's Hearing Continued

The Sleepy Hollow man accused of throwing a bomb in an Algonquin fruit market has his schedule for a preliminary hearing continued until Sept. 30.

A Sleepy Hollow man charged with felony aggravated arson had his case continued in McHenry County Courthouse Aug. 26 without stepping before the judge. 

Attorney for Fabian J. Torres, 24, requested and was granted a continuance to schedule his client’s preliminary hearing until Sept. 30. 

Torres, held at McHenry County Adult Corrections Facility on a $2 million bond, did not appear in the courtroom.

According to the complaint, the former employee of Joe Caputo & Sons Fruit Market in Algonquin threw a bottle filled with flammable liquid into the store on Aug. 21, knowing that people were inside the store and might be injured. 

Judge Gordon Graham appointed Woodstock attorney Bill Bligh as special public defender on Aug. 22.

Bligh did not immediately return a phone call as to why the case was continued or why he filed a motion the day before requesting another judge to preside over the case. 

The Class X felony charge carries a prison sentence of up to 30 years and fines of up to $25,000 if convicted. 

Algonquin Deputy Police Chief Steve Kuzynowski said McHenry County State’s Attorney was reviewing the case to see if additional charges would be filed. 

“I think there was only one person that was actually injured and at this point it’s not a major injury,” Kuzynowski said.
