Couple Plead Not Guilty To Murder, Prostitution Charges

A Woodstock couple enters pleas in May 28 shooting death of owner of Dirty Hog Saloon owner Kurt Milliman.

Timothy Smith wept before McHenry County Judge Sharon Prather on June 24 as she outlined the charges against him and their penalties relating to the May 28 . 

The 26-year-old Woodstock man is accused of pimping his wife through a craigslist advertisement for $40 and killing Kurt Milliman, 48, with a .38-caliber handgun in the couple’s Woodstock home after Milliman responded to the ad.

Because the first-degree murder charge involved a firearm, Prather said the sentence carries a prison term of 45 years to life if convicted.

Smith pleaded not guilty to the murder charge and those of pandering, pimping and obstructing justice. 

Police allege Smith planted false evidence by having his wife call his cell phone in an attempt to show he wasn’t at home at the time of the incident.

He remains in McHenry County Jail on $900,000 bond. 

His wife, Kimberly Smith, also appeared in Prather’s courtroom for arraignment that day. She pleaded not guilty to two counts of obstructing justice, prostitution and disorderly conduct related to the same incident.

Police say the 28-year-old woman obstructed justice by reporting a nonexistent home invasion the night of the shooting and saying Tim Smith was not at home at the time. 

She also remains in jail on a $15,000 bond, which on June 6 was reduced from $50,000. 

Her attorney, Special Public Defender Colin MacMeekin, asked the court to release Kimberly Smith’s vehicle, because it has been determined to have no evidence bearing on the case. 

Prather granted the request and ruled that Kimberly Smith’s sister be allowed to obtain personal property from the vehicle, including a wallet with cash that MacMeekin said she needed to apply to her bond. 

Tim Smith's next court appearance is July 1; Kimberly Smith's is July 22.

He owned the popular Island Lake biker bar, Dirty Hog Saloon, which has not been open since his death.
